With rental demand remaining strong across South Africa, many tenants focus on location and affordability, often overlooking the fine print. Taking the time to understand the terms of a lease can prevent unnecessary stress, financial strain, and legal disputes later down the line.
“Renting a property is a legal commitment, and tenants should approach a lease agreement with the same diligence as any major financial decision,” says Adrian Goslett, CEO and Regional Director of REMAX Southern Africa. “Asking the right questions upfront protects the tenant’s interests and helps build a transparent, positive relationship with the landlord or managing agent.”
Goslett advises renters to first clarify what is included in the monthly rental. Utilities, levies, and service fees may or may not be included, and tenants need to understand how these costs are calculated and billed.
The deposit is another key area of consideration. Tenants should confirm the amount required, how it will be held, what deductions may apply, and how the refund process will work. Ingoing and outgoing inspections also play an important role in determining potential damages that can impact the deposit.
It is equally important to understand the lease term, renewal conditions, and notice periods to avoid penalties or unintended extensions. Maintenance responsibilities should also be clearly defined, including who handles repairs and how issues are reported.
Lifestyle rules, such as policies on pets, subletting, alterations or working from home, should be reviewed carefully, particularly in complexes or estates that have conduct rules.
Tenants should also ask about rental increases and how they are calculated to budget effectively. In addition, while landlords usually insure the building, tenants are generally responsible for insuring their personal belongings.
“Transparency and communication are key to a successful rental experience. Tenants should never feel pressured to sign a lease they have not read or fully understood,” concludes Goslett.
By asking the right questions and seeking professional guidance where needed, renters can enter into lease agreements with confidence and avoid preventable disputes in a competitive market.
